Digital Card Order Terms and Conditions

These iChoose Visa Gift Card Order Terms and Conditions (“Digital Card Order Terms and Conditions”) apply to iChoose Visa Digital Gift Cards (“Cards”) sold by 212F Pty Ltd. By placing an order to purchase the Cards you (“Client”) are agreeing to the Order Terms and Conditions set out below.

DEFINITIONS

  • “212F” means owner and operator of iChoose Visa Gift Cards
  • “Activate” means the action to enable the Cards to be used
  • “Agents” refers to employees, representatives, directors, affiliated entities, subcontractors, service providers or suppliers, of 212F
  • “Card Activities” means any transactions that are conducted on the Cards by the Cardholder
  • “Cardholder(s)” means a customer or staff member of the Client that is a recipient of the Card
  • “Card” means the iChoose Visa Gift Card provided to the Client in accordance with these Terms and Conditions
  • “Card Terms and Conditions” means the Terms and Conditions that apply to the Card
  • “Client” means 212F’s Customer who uses 212F’s services for the purchase of Cards
  • “Country” means Australia
  • “Expiry Date” means the ‘Valid Thru’ date available on the issued digital gift card found at the mydigitalaccount.ichoosecard.com.au, at which time no further Card Activity can take place
  • “Gift Card” means a card that has an initial load and cannot be reloaded
  • “Invoice” summarises the costs and applicable GST charges associated with the Order
  • “Invoice Number” is a unique number used to identify a specific Order
  • “Issuer” means Oxygen Global Pty Ltd ABN 41 162 667 843, AFSL 452 187
  • “Order” is a request by the Client to purchase iChoose Visa Gift Cards to be dispatched to a recipient email address as advised by the Client
  • “Prepaid Card” means a stored value card which has been prepaid by the Client
  • “Website” means mydigitalaccount.ichoosecard.com.au, managed by an agent of 212F that a user of a Card accesses to view all Card activities

SECTION 1: ORDER TERMS AND CONDITIONS

  1. The Client has read and understands the Card Terms and Conditions which are available to the Client and the Cardholder at the website mydigitalaccount.ichoosecard.com.au.
  2. A Card has a 12 expiry month date and will expire at the end of the ‘Valid Thru’ month on the Card. Unused value will be forfeited and cannot be refunded or reloaded. No notice will be given prior to expiry.
  3. 212F shall not be responsible for any Card Activities, or any issues that may arise pursuant to the Card Activities unless such issues arise due to incorrect information supplied by 212F to the Client.
  4. Cards that have been issued are not exchangeable, refundable, replaceable or transferable for cash or credit under any circumstances.
  5. 212F is not responsible for lost or stolen Cards. Once Cards are sent via email to the nominated Cardholder, the Client is responsible for all Cards.
  6. Cards will be sent to the email address of the Cardholders as provided by the Client to 212F at the time of order. Once issued and sent via email to the Cardholder(s) all risk concerning the Cards rests with the Client and their Cardholders.
  7. The Client shall refer the Cardholder directly to the iChoose mydigitalaccount Website mydigitalaccount.ichoosecard.com.au, for any queries or problems the Cardholder may have in relation to the Card Activities.
  8. 212F warrants that it has the appropriate agreements in place with the Issuer to enable it to arrange the delivery of the Cards.
  9. Cards cannot be reissued if lost, stolen or pass the expiration date.
  10. The Cardholder(s) will have the ability to activate cards up to the 'Expiry Date' via the mydigitalaccount.ichoosecard.com.au.
  11. If Cards have not been activated by the Cardholder, unused value will be forfeited and cannot be refunded or reloaded. No notice will be given prior to expiry.
  12. Client must be aware and is responsible for the management of the Card expiry date. Once created the Cards expiry date cannot be extended for any reason.
  13. 212F reserves the right to the cancel an Order at any time, without notice for any reason.
  14. In the event of a cancelled Order that has not been processed, any payments processed will be refunded to the Client promptly.
  15. 212F reserves the right to not accept Orders, including those that request commercial quantities of gift cards. If 212F is unable to supply your Order, it will endeavour to contact you to discuss whether you wish to proceed with part of the Order.
  16. Placement of an order by you is an irrevocable offer by you to purchase the Gift Cards.
  17. Under no circumstances can cards be on-sold to other entities unless agreed in writing with 212F.
  18. To order Cards you must be an Australian registered business with a Australian business address and Australian Business Number (ABN).
  19. We may be required to verify your identity before providing relevant services and products to you. You must satisfactorily meet our customer identification process and policies. If you are not able to verify your identity and/or a Cardholder’s identity to our satisfaction, as exercised at our sole discretion, we may refuse to accept your application and/or provide you with Cards.
  20. In certain circumstances we may also ask you to provide us with additional details, including but not limited to your source of funds. We may ask you to provide additional information in relation to your identity and/or source of funds at any time.
  21. You must provide all information to us which we reasonably require in order to manage anti-money laundering or counter-financing of terrorism and economic and trade sanctions risks or to comply with any laws or regulations in Australia or any other country.

FEES AND PAYMENTS

  1. Payments for Orders can be made by Visa, MasterCard, or Electronic Fund Transfer (EFT) only.
  2. 212F will process payment for your Order, plus any delivery charges, credit card surcharge, taxes and service fees as itemised within the tax invoice.
  3. The Client authorises 212F to debit the Total Amount from your nominated credit card.
  4. If the nominated credit card is declined by your financial institution, 212F will not be required to fulfil the Order, and may contact you to make alternative payment arrangements.
  5. If you select EFT as the payment option, you will be provided with our bank details. The Client must include the invoice number as the reference number with the bank transfer otherwise the Order may be delayed.
  6. 212F will not process an Order until the Client pays 212F for all the fees, costs and taxes stipulated in the Order.

DELIVERY OF GIFT CARDS

  1. Cards are only available for issuance within Australia.
  2. The Client is solely responsible for providing the correct email address for the delivery of Cards to the Cardholder(s). 
  3. 212F will not be liable for any incorrect Cardholder(s) email content entered when ordering Cards. 
  4. At times, Cards may not be available and 212F do not take any responsibility for this.
  5. 212F will not be liable to the Client or anyone else for any losses suffered or incurred due to nondelivery Cards, including Cards lost or reference emails deleted.
  6. Client must notify 212F immediately of any suspected security issues relating to the delivery of the Cards.
  7. Activation of the Cards is the responsibility of the Cardholder(s). The Cardholder must provide mobile number for a one time password (OTP), Card reference number provided in the Card issuance email. Without these details 212F will not activate the Card.  

SECTION 2: DIGITAL CARD TERMS AND CONDITIONS

These Terms and Conditions apply to the iChoose Visa Prepaid Digital Card (“Card”). The Card is issued by Oxygen Global Pty Ltd (“Oxygen”) ABN 41 162 667 843, AFSL 452 187 and distributed by 212F Pty Ltd (212F) ABN 70 106 450 631.

In these Card Terms and Conditions, “we”, “us” or “our” means Oxygen and “you”, “your” or “user” means the cardholder. If you acquire the Card, you will have a contract with us.

When we refer to a Card, it means the digital card issued by Oxygen and where we refer to Card Details, we are referring to the card number, expiry date and the 3 digit CVV number (security number).

When we refer to a Tokenised Card it means a card that has had sensitive personal information (including, but not limited to, a PAN) substituted for a unique identifier (token) and stored within a Device Wallet for you to use as payment.

When we refer to a Digital Wallet, we are referring to Apple Pay or Google Pay and when we refer to a Device, we are referring to a mobile or wearable device that allows you to store or otherwise add a Card to a Digital Wallet.

Where we refer to the Website, we are referring to mydigitalaccount.ichoosecard.com.au.

Accepting the Card and Agreeing to these Terms and Conditions

  1. You agree to be bound by these Terms and Conditions by using the Card in any capacity including, but not limited to, using any Card features or completing a transaction with the Card.
  2. If you allow other users of the Card, you must provide them with these Terms and Conditions.
  3. Use and access to the Tokenised Card is subject to your respective Device capability. This means your Device must have the ability to store the Card and make a purchase using a Digital Wallet.

How and where you can use the Card

  1. The Card is a digital prepaid card that you can use for purchasing goods and services at merchants and terminals that accept digital payments and cannot be used at ATMs or over the counter at financial institutions.
  2. Attempts to use the Card at merchants that do not accept digital payments will result in a declined transaction.
  3. The Card must be activated before use.
  4. To activate the Card, you must follow the activation steps at mydigitalaccount.ichoosecard.com.au

Limitations of the Card

  1. If your Card is a Gift Card, the card cannot be reloaded.
  2. You can only use the available balance on the Card, the Card is not a credit Card and will decline if the transaction amount is greater than the card balance.
  3. The Card is not a credit card and nor is it linked to a deposit account with us.
  4. The Card cannot be used to obtain or redeem cash. You may not use the Card to withdraw cash.
  5. The Card cannot be used at ATMs or over-the-counter at financial institutions.
  6. The Card cannot be used for making direct debit, recurring, or regular instalment payments.
  7. Use of the Card may be declined at some merchants (such as gambling merchants or merchants who choose not to accept the Card). We are not liable in any way when authorisation is declined for any particular transaction except where the authorisation has been declined because of an act or omission on our part.

Transaction and Balance Limits

  1. The following table illustrates the transaction and balance limits applicable to the Product. Please check your card balance prior to making transactions. Merchants or other providers of facilities may impose additional limits.

Checking your Card balance and Transaction History

  1. You acknowledge and agree that we do not provide you with paper statements. Card transaction activity and balance information can be found by accessing the website.
  2. You are responsible for checking your transaction history and knowing the available balance for the Card.
  3. You are responsible for ensuring the availability of sufficient funds for all transactions. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees. In the event the available amount on the Card is less than the purchase amount, some merchants may not allow you to combine multiple payment types to complete the transaction.

Validity and Card Expiry

  1. The Card expiry date is shown on the digital Card image and will be entered into your device when provisioning the card. The Card cannot be used after expiry and cannot be replaced.
  2. At expiry, any remaining balance will be forfeited, and the Card will be declined when presented for use. We will not give you any notice before this happens.

Your Card, your Responsibility

  1. The Card is like cash. Unauthorised transactions can happen using the Card if the Card number is shared, your device is lost or stolen, you don’t have security on your device or your device PIN is revealed to any other person, or because of fraud.
  2. We have no obligation to replace or refund value for misused, lost, stolen or damaged Cards.
  3. You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents.
  4. Except to the extent required by law, we are not liable for any loss or damage arising out of or in any way related to the use of the Card, including:
    a) if authorisation is declined for any transaction, except where the authorisation has been declined because of an act or omission on our part;
    b) if you permit someone else to use the Card, you will be responsible for any transactions initiated by that person with the Card;
    c) the availability of merchants who allow the use of the Card as payment;
    d) reduced levels of service caused by the failure of third-party communications and network providers.

Refunds or Exchanges

  1. Any refunds on Card transactions are subject to the policy of the specific merchant.
  2. Refunds may be in the form of a credit to the Card or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund then you will have no access to those funds.

Errors and Complaints

  1. If you notice any error relating to the Card or have a query about the Card, you should notify card support immediately by sending an email to hello@ichoosecard.com
  2. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant or have a complaint you can send an email to hello@ichoosecard.com
  3. If we discover an error in the amount of funds loaded, received or used for any reason, we are authorised to rectify the error without further notice to you, including but not limited to debiting the equal amount of funds found in error from your Cards available balance.

Privacy and Confidentiality

  1. Information will be disclosed to third parties about the Card, or transactions made with the Card, whenever allowed by law, and where necessary to operate the Card and process transactions. Privacy Policy available at: https://www.212F.com
